SOURCES AND CATEGORIES OF PERSONAL DATA PROCESSED

The Controller processes personal data that You have provided to the Controller or personal data obtained by the Controller in connection with the fulfilment of Your Order.

The Controller processes Your identification and contact details and the information necessary for the performance of the Agreement.

LEGAL BASIS AND PURPOSE OF PERSONAL DATA PROCESSING

The legal basis for the processing of personal data is:

• the performance of the Agreement between You and the Controller pursuant to Article 6(1)(b) of the GDPR;
• the Controller’s legitimate interest in direct marketing, in particular the sending of commercial communications and newsletters, pursuant to Article 6(1)(f) of the GDPR;
• Your consent to processing for direct marketing purposes, in particular the sending of commercial communications and newsletters, pursuant to Article 6(1)(a) of the GDPR in conjunction with Section 7(2) of Act No. 480/2004 Coll., on Certain Information Society Services, where no Goods or services have been ordered.

The purpose of processing personal data is:

• to process Your Order and exercise the rights and obligations arising from the contractual relationship between You and the Controller;
• to process the personal data required for the successful completion of the Order, particularly Your name, address and contact details;
• to send commercial communications and carry out other marketing activities.

The provision of personal data is a necessary requirement for the conclusion and performance of the Agreement. Without the provision of personal data, the Agreement cannot be concluded or performed by the Controller.

The Controller does not carry out automated individual decision-making within the meaning of Article 22 of the GDPR. You have given Your explicit consent to such processing.

PERSONAL DATA RETENTION PERIOD

The Controller retains personal data:

• for the period necessary to exercise the rights and obligations arising from the contractual relationship between You and the Controller and to assert claims arising from such contractual relationships;
• until consent to the processing of personal data for marketing purposes is withdrawn, where personal data is processed on the basis of consent.

RECIPIENTS OF PERSONAL DATA

The recipients of personal data are persons and entities:

• involved in the delivery of Goods, provision of services or processing of payments under the Agreement;
• providing the operation of the E-shop and other services related to the operation of the E-shop;
• providing marketing services.

The Controller does not intend to transfer personal data to a third country outside the European Union or to an international organisation.

YOUR RIGHTS

Under the conditions set out in the GDPR, You have:

• the right of access to Your personal data pursuant to Article 15 of the GDPR;
• the right to rectification of personal data pursuant to Article 16 of the GDPR or to restriction of processing pursuant to Article 18 of the GDPR;
• the right to erasure of personal data pursuant to Article 17 of the GDPR;
• the right to object to processing pursuant to Article 21 of the GDPR;
• the right to data portability pursuant to Article 20 of the GDPR;
• the right to withdraw Your consent to processing in writing or electronically at the Controller’s address or e-mail address stated in Article III of these terms.

You also have the right to lodge a complaint with the Office for Personal Data Protection if You believe that Your right to the protection of personal data has been infringed.

PERSONAL DATA SECURITY

The Controller declares that it has adopted all appropriate technical and organisational measures to secure personal data.

The Controller has adopted technical measures to secure electronic data storage and personal data stored in physical form.

The Controller declares that only persons authorised by the Controller have access to personal data.
